It’s no secret: Biden has issued a vaccine mandate. He’s blasted it from the airways that you must be vaccinated or else, particularly if you work for a company of 100 employees or more. In most communities, this means hospitals, police departments, factories, and, of course, the already mandated armed forces of the USA.
But what if a mandate for vaccination didn’t actually exist? What if, instead, Biden and his administration were merely using the power of the press and the word ‘mandate’ to make people think they have to comply or risk losing their job?
Well, as a matter of fact, that is exactly what has happened.
There is no mandate, no executive order, no law, or even federal regulation that says anyone has to get the vaccine. And I mean, anyone. After all, such a mandate would not only be immoral but completely illegal and unconstitutional, and Biden knows it.
Why do you think you’ve only heard mumblings about lawmakers and states taking Biden to court over the issue and not seen any real action? It’s because there’s nothing legitimate to argue or fight.
As executive editor of the Federalist, Joy Pullmann, says, this isn’t a mandate. It’s a dictatorship by press release.
Now, that isn’t to say that Biden hasn’t made it seem like there is.
According to Bloomberg Law, when Biden announced his ‘mandate,’ he immediately contacted the Occupational Safety and Health Administration or OSHA, pleading with them to write new rules requiring his wishes be made a reality. Either employees of large companies be vaccinated, or they will have to submit to weekly COVID-19 testing to prove they do not have it.
And OSHA is making efforts to do so. However, it’s not in play yet, and there’s a massive chance it may never be.
The only way it can be accomplished is if OSHA invokes what is called an emergency temporary standard or ETS, which happens when “workers are in grave danger due to exposure to toxic substances or agents determined to be toxic or physically harmful or to new hazards and that an emergency standard is needed to protect them.”
Assumably, they believe COVID-19 to be such a danger, even though the chances of dying from it are less than one percent…
But I digress.
Should an ETS be invoked by OSHA, it is then sent to the Federal Register to be considered as a permanent rule. Only then will be final rulings be made, and adoption procedures for the regulation be implemented.
But even then, it’s not a sure thing. As both OSHA and multiple other sources can attest, any ETS can be challenged by a US Court of Appeals.
And the history of such challenges doesn’t bode well for Biden’s wishes.
According to the Wall Street Journal, only one ETS out of ten has been upheld by US courts in the last 50 years. Just one in the past half a century…
Not very good odds, huh?
However, that is kind of the point, and no doubt by design, as it ensures that OSHA “can’t easily circumvent the ordinary rule-making process,” the Journal says. In such cases, these ETSs are given what the courts call a “hard review,” which is far more “stringent” than those given to ordinary economic regulations.
Clearly, few of them pass.
But, of course, the Biden administration nor large companies really want you to know all that. Instead, they simply want you to see it as a mandate that you must comply with. Biden said it must be so and so it is.
As Minneapolis employment lawyer Kate Bischoff told Bloomberg Law, “Everybody loves this cover,” particularly since many companies were already trying to find a way to implement vaccine ‘mandates.’ She says, “the fact that they get to blame Biden is like manna from heaven.”
And already, stories are coming to us from nearly everywhere about people being fired from their jobs for refusing to get the vaccine, some of whom have given that company 20 or more years of their life.
But it will only last so long as the people don’t realize they don’t have to comply. When people begin understanding that this is merely Biden trying to tell you what to do, and without a law backing it up, that will be the end, not only of the supposed mandates but likely of Biden too.
